Steve Proulx has the scoop on the employer’s demands for the Journal de Montréal union, whose contract expires Dec. 31.

Some are debatable points that the Journal de Québec union eventually conceded, like bringing the work week to a more reasonable 37.5 hours per week (5 days) instead of the spoiled-rotten 32 (4 days), or having people work in multiple media and being able to reuse content online.

Others go against the entire point of having a union, like having carte blanche to subcontract and outsource work.

And then there’s the 20% salary reduction. Ouch.

Needless to say, the union has rejected all of these demands.

Strike ends at Winnipeg Free Press

Workers at the Winnipeg Free Press, who have been on strike for two weeks now, last night voted to approve a new contract presented by their employer. Details are a bit sketchy, but the wage increases are 2% a year, with 1.5% during the final 9 months. The employer apparently also took the merging of newsroom jobs off the table.

The union executive didn’t recommend the contract to its members (it didn’t recommend against it either, saying it needed a mandate from members before it could go further). But the union tells CP it thinks it got a fair deal. (More coverage from Reuters and UPI)

The FreePressOnStrike.com website has been shut down, and the Free Press will be published again starting tomorrow.

Free Press dispute gets nasty

(Not that I’ve ever witnessed a labour disruption that didn’t get tense)

Normally, in a show of good faith and to allow the bargaining process to proceed, both sides of a labour negotiation will keep the details of what’s said during talks to themselves. The union will advise its membership of any major issues, as well as give a general idea how talks are going, but that’s about it.

When the door closes and workers are on strike or lockout, that changes. It usually starts with the union, which decides to negotiate through the media. Inevitably, the employer responds to correct any “fals” or “misleading” statements that sully its good name.

The Winnipeg Free Press is on that course. Workers went on strike last week and quickly started up a competing news website at freepressonstrike.com, which includes news about the strike itself.

Yesterday, the Free Press (which can’t put out a newspaper and is instead just posting updates to its website) issued a statement correcting the record and offering its side of the dispute. Its main argument is that workers are paid well (better than at other papers) and get good benefits (like sick leave and holidays and stuff!). That statement led to stories from Canadian Press and CBC (the latter also talks about some silliness involving pork).

The striking workers countered with their own statement that many workers are paid at or near (or even below) minimum wage, and that it has been open and honest, posting offers on its website for all to see.

Unfortunately, both statements make both sides look childish in this process, and are good indications for why this kind of thing is normally not done. Both sides essentially accuse the other of being unreasonable and refusing to negotiate. It’s like two three-year-olds complaining to their mother that the other one is being mean.

Meanwhile, talks resumed this morning, as the union issued another statement that it had begun picketing a non-union shop that was distributing flyers for the FP (the publisher does not understand why a union on strike would have a problem with that?)

Here’s hoping those talks go well.

Taking a page from the Journal de Québec workers who started their own publication when they were locked out, the striking workers at the Winnipeg Free Press have started up their own website at freepressonstrike.com with local news.

It includes an FAQ as well as embarrassing coverage of Free Press owner FP Newspapers (though pointing out that your employer is bleeding money doesn’t sound like it will get the public on your side when you demand more money)

As Canadians went to the polls today, editorial, advertising and reader service employees at the Gazette staged a lunch-hour information picket line, carrying signs and handing out leaflets explaining the situation to passers-by. The union, which is negotiating with management for a new contract (the previous one expired June 1), received a strong strike mandate but has so far not exercised it. Conciliation talks are scheduled for next week.

Turnout was pretty good considering there are less than 200 members affected (this includes the entire editorial department). Picket signs surrounded the building on all four sides for about an hour and a half.

Media coverage was very light, considering there’s this whole election thing is going on (have you voted yet?) and all hands on deck fanned out to swing ridings. But a radio reporter and photographer showed up, so you might see a tiny bit of coverage.

The key, though, is that this is just the beginning of the union’s public information campaign (should such a campaign become necessary).

Meanwhile, The Link covers the Gazette labour conflict and byline strike, and has an editorial which posits that in the new digital age, quality of journalism becomes key and wire copy doesn’t cut it anymore.

And La Presse also covers the Gazette today, focusing on the Canwest student scab situation. It includes a new explanation from Canwest, that the student freelancers would be needed mainly to provide material to other newspapers to compensate for the Gazette loss (Canwest has no Montreal bureau and relies on Gazette copy for news from Canada’s second-largest city). Of course, such articles would also be available to The Gazette.

Vultures circling as talks continue

I’ve been a bit quiet about contract negotiations at the Gazette since the strike vote, and that’s mainly because there’s nothing to report. Both sides were in talks Thursday and will return to the table Friday. People are optimistic, but the work-to-rule campaign and byline strike continue, and the guild has suggested employees bring personal effects home.

The Montreal Newspaper Guild website has the latest update, which also points out that talks for the 37 employees in the (non-classified) advertising department have broken off.

UPDATE (Oct. 10): No strike is being called for the foreseeable future. Friday’s talks had progress, though jurisdiction remains a roadblock. Conciliation talks are set for Oct. 20 and 21, and the guild says that “additional measures” are necessary to show that the union is “serious” about its demands.

Meanwhile, management is apparently preparing for the worst, with Canwest News Service making inquiries of Concordia University journalism students (and Gazette freelancers) who might want to work freelance for them in the event of a strike. Because they’d be working for Canwest and not The Gazette (even though Canwest owns The Gazette), they would not be breaking Quebec’s tough anti-scab laws, even if what they write is of local interest and would only appear in The Gazette.

Concordia’s journalism department director, Mike Gasher, has sent a letter to students cautioning them against working as freelance scabs, Macleans reports.

UPDATE: CBC has picked up the story (with requisite “CBC has learned” which implies they didn’t just read it from Macleans’ blog), and J-Source has picked it up from CBC. The CBC story includes a denial from Canwest News Service’s editor-in-chief that the inquiry has anything to do with a possible Gazette strike.

UPDATE (Oct. 14): La Presse also writes about the story, this time including a new explanation from Canwest: that the freelance copy would be needed in the event of a Gazette strike in order to provide material for Canwest News Service and other newspapers across Canada, to compensate from the loss of Gazette copy (Canwest has no non-Gazette journalists in Montreal). Of course, as a subscriber to Canwest News Service, The Gazette would have access to this copy as well.

Journal in negotiations

As if that weren’t enough, workers at the Journal de Montréal are also at the bargaining table for a new contract, mere months after their sister union at the Journal de Québec accepted a new contract that removes their four-day work week and requires journalists to perform multiple multimedia jobs.

Updates are on the Journal du Journal website. So far nothing too serious is coming out, besides low-level pressure tactics like wearing yellow lanyards.

Still, management at La Presse are no doubt creaming their pants multiple times over at the thought of their two main competitors both being crippled by work disruption simultaneously.

Just figured I’d throw this in there: the Writers Guild of America is telling members not to work for Freemantle Media, which produces a new Ozzy Osbourne “reality” show, because they couldn’t reach a deal that would involve paying writers less in order to write less (because it’s “reality” and therefore “half-scripted”).

Gazette staff start byline strike

You know, everything happens on my day off.

In case you hadn’t noticed, Thursday’s paper was missing names on top of articles written by Gazette reporters (and under photos by Gazette photographers). The union called for a byline strike as a pressure tactic after being frustrated by negotiations.

For those who want some background, Slate explains what byline strikes are all about. The last time Gazette staffers did this was in 2001 to protest a new national editorial policy by Canwest, one that many people have asked me about years later thinking it’s still in effect.

UPDATE: Bylines are also being pulled from Habs Inside/Out.

So you all can just go ahead and assume all the articles are being written by me now. Yeah, that’s the ticket.

Gazette editorial dept. votes 98% for strike mandate

At a general meeting Sunday afternoon, members of three bargaining units at the Montreal Newspaper Guild, which represents workers at The Gazette, voted overwhelmingly in favour of a strike mandate.

The results:

  • Editorial: 98% (Representing reporters, photographers, photo processors, desk clerks, graphic artists and copy editors including myself)
  • Reader Sales and Service: 100% (Representing what’s left of the department after the call centre was outsourced to Winnipeg)
  • Advertising: 59% (Representing sales staff and other advertising workers outside the classified department)

Turnout was 70% of the 182 members.

Two other units, representing the business office and classified advertising, are currently under contract and are unaffected by this.

This vote greatly strengthens the union’s bargaining position as the two sides return to the table on Tuesday. It does not necessarily mean there will be a strike, but it does give the bargaining committee the power to call one if negotiations break down and they decide it’s necessary. The employer is currently in a lock-out position.

The main issues on the table are:

  • Jurisdiction (a clause in the collective agreement that prohibits the employer from hiring non-unionized employees to do work normally done by the union, a clause that the guild argues is already being violated by the outsourcing of copy editing to Canwest Editorial Services in Hamilton, Ont.)
  • Wages (the employer is offering no wage increase, the union’s starting demand is 6% per year)
  • Job classification (the employer is asking that the distinction between reporter, critic, photographer and graphic artist be eliminated so employees can be forced to do jobs in more than one of these categories for no extra pay)

This strike mandate vote follows a similar one by the Ottawa News Guild representing workers at the Ottawa Citizen. They voted 83% in favour (though they had a higher turnout) and eventually settled on a 2-2.5% wage increase over five years (double what the employer had offered before the strike vote), with no jurisdiction guarantees.

UPDATE: Le Devoir has a brief about it. It describes the job classification issue as the “main issue,” which I think is debatable. The Gazette also has a brief, including a quote from publisher Alan Allnutt about how surprised he was by this vote.

STM drivers do OT: The horror!

Matinternet has a piece about an Info690 report that plagiarizes (without attribution) an OMGclusive article in the Journal de Montréal this morning that says bus drivers in Montreal are doing a lot of overtime, a few of them even doubling their salary with all the extra work they do.

I guess this is news for some people. If you’ve ever seen an STM driver’s schedule (four hours on, two hours off, three hours on, etc.), you’d start to understand a bit better.

The articles, of course, offer no solutions to this problem. The STM is doing the best they can to hire more drivers, but that takes time, and the number of retirements is creeping upward at the same time as the transit agency wants to add more service.

940 union upset at “fire everyone” plan

The Communications, Energy and Paperworkers union has swiftly moved to denounce the 940 News layoffs, only a month after the fact and a week after the station’s new format launched. Specifically, they’re complaining that the change violates the station’s CRTC license, which establishes an all-news format (at least I’m pretty sure it does — I can’t find the conditions of license on the CRTC website).

But if the TQS situation showed us anything, it’s that the CRTC’s programming requirements for station licenses have an unwritten “it’s not making us enough money” exemption. So not only can you slash staff and radically change a format without getting a license amendment, you can do so without consulting the CRTC, and simply ask for a format change after the fact.

Until the CRTC grows some balls, expect more of these kinds of moves: money-losing broadcasters unilaterally switching to cheap, lowest-common-denominator formats and laying off all but a skeleton staff.

Union approves deal at Journal de Québec

Employees at the Journal de Québec have voted overwhelmingly in favour of a deal in principle with their employer, starting the process to end the labour conflict after more than 14 months out of work.

The deal, worked out overnight during intense negotiations, includes the following points:

  • A five-year contract
  • 2.5% pay increases per year
  • An end to outsourcing of classified jobs to Kanata, Ont.
  • A four-day, 37.5-hour work week (9 hours, 22 minutes and 30 seconds a day), except for classified which work 37.5 hours over five days
  • A week more of vacation for part-time/temporary workers who have worked more than 10 years
  • A guaranteed minimum number of journalists covering Quebec City news, but allowing reporters to perform multimedia jobs
  • Changes to pensions and retirement benefits, plus a bunch of other stuff that I’m sure even union members didn’t care much about

The union says that MédiaMatinQuébec will continue publishing until the employees return to work, which is still weeks away.

Analysis

The terms of this deal seem to be a pretty solid down-the-middle compromise on key points (which prompts me to ask the question: Why the heck did it take so long to hammer out a deal?). The 2.5% per year increase and 37.5-hour work week is consistent with the employer’s demands, but the workers keep their four-day week intact and avoid outsourcing of jobs to non-unionized employees elsewhere.

The announcement doesn’t go into much detail about the other main issue: asking workers to perform multimedia jobs in addition to print reporting. It will be interesting how this major sticking point is eventually resolved.

This conflict has had mixed reaction from the public. Some have questioned some of the seemingly unreasonable clauses the contracts contain (starting with the four-day work week) and said the Journal needs much more flexibility. But most came out on the side of the workers, thanks in large part to MédiaMatinQuébec which laid out their position on a daily basis and made them out to be the underdog against the evil corporate media empire of Quebecor.

If this conflict is finally resolved, it will be good news for the Journal, good news for its workers, and will change the face of media union pressure tactics here for a long time.

But in the end, only one winner emerges from the prolonged, 14-month conflict at the Journal de Québec: Le Soleil, its direct competition.

Comparisons to the Montreal Star, which folded after a prolonged strike, are already being made.

Now we wait and see what happens at the Journal de Montréal, which is also in contract negotiations.

Well, not exactly. The Journal’s union has a website. Hot off the success of union websites from such outlets ad the Journal de Québec, TQS and The Gazette, workers at the Journal de Montréal concerned about the possibility of a lockout have started their own website called Journal du Journal (cute).

Well, actually the archives suggest the site’s been up for more than a year, but it’s the first I’ve seen of it (which is its first problem), so let’s pretend it’s new.

Gazette call centre gets pink slip

The notice from the union was in my mailbox when I came in today: The Gazette and its workers union, the Montreal Newspaper Guild, have reached an agreement concerning workers in the Reader Sales and Service department whose jobs are being outsourced to a Canwest call centre in Winnipeg.

The deal essentially turns the layoffs into forced buyouts, with a deal similar to what many in the editorial department took in January. It comes after the union lost a bid to merge the RSS bargaining unit with the editorial and advertising ones, which would have leveraged the power of the latter to save the former.

It’s sad that the jobs are going, and that people calling about their morning paper are going to speak to a minimum-wage call centre guy on the night shift in Winnipeg than someone in the Gazette building who knows about the paper and the city and actually cares about readers.

Where’s the line between union and journalist?

Last week, MédiaMatinQuébec, the Journal de Québec locked-out/striking workers paper that I’ve discussed here many times before, decided it would refuse ads from Quebec City’s administration, which is involved in its own labour issues. The city paid for ads in MMQ that explained its points in its negotiation with its union. But because that union supports MMQ, the paper decided it could no longer take advertisements that served to attack its allies.

Was a line crossed here? It’s one thing when MMQ refuses to take ads from Le Soleil, which has a vested interest in making the Journal conflict go on for as long as possible. But Quebec City has nothing to do with Quebecor.

Then again, the entire raison d’être of MMQ is as a union pressure tactic. Should we expect a union-produced newspaper to betray those who support it?

I guess it comes down to a simple question: Is MédiaMatinQuébec a newspaper, with a duty to be objective, or is it a union pressure tactic, whose content should further its ultimate goal?
